There has been huge news released in terms of CBD this week! The Drug Enforcement Agency (DEA) has released an internal notice to all staff members and agents in the field confirming that products and various materials containing cannabinoids are NOT illegal.
You read that right.
They also stated that it depends whether the product is legal or not, that will determine if it falls inside or outside of the Controlled Substances Act. This means if the product isn’t legal and it contains CBD, then it would fall under the act but if it is a legal product that
contains CBD, then they both are outside the act and legal. The actual notice states the following about this.
Products and materials that are made from the cannabis plant and which fall outside the CSA definition of marijuana are not controlled under the CSA. Such products may accordingly be sold and otherwise distributed throughout the United States without restriction under the CSA or its implementing regulations. The mere presence of cannabinoids is not itself dispositive as to whether a substance is within the scope of the CSA.
Up until this point, people have believed that there has been a legal “gray area” in terms of CBD. The truth is, it states in federal codes and bills that it isn’t illegal. The issue here is that some people can’t really understand or interpret this correctly, so they aren’t sure where the law really lies. With the DEA releasing this statement, they are a higher authority settling the debate once and for all. They are letting everyone know that CBD is, in fact, legal, if the product it’s in is legal. Pretty straightforward.
CBD is safe & doesn’t carry the risk of dependency!
Many people have advocated for CBD in terms of being safe and helpful for various medical issues. In fact, the World Health Organization did a study and released a report on it in November 2017. This is what they had to say about it.
In humans, CBD exhibits no effects indicative of any abuse or dependence potential…CBD is generally well tolerated with a good safety profile…To date, there is no evidence of recreation use of CBD or any public health related problems.” The World Health Organization always does extensive research and testing before releasing any statements, so you know this was the same.
When a substance is placed on the Controlled Substance Act, it needs to not only have a high chance of abuse, but also a high chance of dependency. In addition, just because a natural substance occurs in one of the substance already on the list, such as CBD, it doesn’t automatically put that natural substance on the list. In fact, the CSA has said that the only part of marijuana that is on the CSA is Delta 9 THC. This means none of the other cannaibniods found in the plant are on the list.
It’s time the federal government changes the way it looks at hemp
In terms of what will happen in the future, there’s currently pending legislation in the 115th congress. The name of this legislation is the “Hemp Farming Act of 2018.” Not only is there bi-partisan support, but it has a pretty good chance of getting approved and signed into law. One of the main supporters of this bill is Senate Majority Leader Mitch McConnell.
When the bill was released, there was a press conference. At this press conference, he stated:
It’s time the federal gov changes the way it looks at #hemp, which is why Senator @RonWyden and I, along with @SenJeffMerkley, are introducing legislation that will modernize federal law in this area & empower American farmers to explore this promising new market.
While some people are still confused about the different legal aspects and some people still don’t know how much they help various conditions, the future looks great. This is the first step towards legalization and helping everyone understand CBD in its entirety.
